Terms of service for using the Resource Jobs platform.

Welcome to Resource Jobs, operated by Sigmoidal Proprietary Limited (ABN: 58694150171) ("Resource Jobs", "we", "us", or "our"). These Terms and Conditions ("Terms") govern your access to and use of resourcejobs.au, our web application, job-search tools, AI-powered document tools, application kits, subscription services, and related features (together, the "Service").

Important Subscription Notice

Some parts of the Service are provided through paid subscriptions that continue until cancelled. If you start a trial, discounted, promotional, or introductory offer, that offer may convert to a paid subscription at the price, billing interval, and renewal terms shown at checkout unless you cancel before the next renewal is processed.

You can cancel your subscription from Account Settings > Billing. Cancellation prevents future renewals, but does not automatically refund amounts already charged. Deleting your account, closing your browser, uninstalling a shortcut, not using the Service, or telling your bank you do not recognise a payment does not cancel your subscription.

Please read the sections on Fees, Subscriptions and Cancellation, Refund Policy, and Payment Disputes and Chargebacks carefully before purchasing.

1. Acceptance of Terms

By accessing or using the Service, creating an account, uploading content, starting a trial, completing checkout, or using any paid feature, you confirm that you have read, understood, and agree to these Terms and our Privacy Policy.

If you do not agree to these Terms, you must not use the Service. If you use the Service on behalf of another person or organisation, you represent that you have authority to bind that person or organisation.

We may update these Terms from time to time. The updated version will be posted on this page with a new "Last Updated" date. Your continued use of the Service after the updated Terms are posted means you accept the updated Terms. If you do not accept an update, you must stop using the Service and cancel any active subscription before the next renewal is processed.

2. The Service

Resource Jobs provides software tools and content for job seekers in the mining, FIFO, resources, construction, energy, and related sectors. Depending on the features available to you, the Service may allow you to:

  • Browse and search job listings.
  • Create and manage a job seeker account or profile.
  • Upload resumes, cover letters, job descriptions, and related materials.
  • Generate, tailor, review, score, edit, and download resumes, cover letters, and application materials using AI.
  • Create and manage application kits and job-search checklists.
  • Track usage, subscription access, billing status, and account settings.
  • Receive job alerts, product emails, support messages, and marketing communications where permitted.

We may add, modify, suspend, limit, or discontinue any feature at any time. Some features may be free, limited, experimental, usage-capped, or available only with a paid subscription.

3. Not an Employer, Recruiter, or Employment Agency

Resource Jobs is software and information tooling. We are not an employer, recruitment agency, labour hire provider, migration agent, financial adviser, legal adviser, or career guarantee service.

We do not guarantee that you will obtain interviews, job offers, employment, visa outcomes, salary increases, employer responses, or any other job-search result. Job-search outcomes depend on factors outside our control, including your skills, experience, qualifications, right to work, conduct, market conditions, employer decisions, and the quality and volume of applications you submit.

You are responsible for deciding whether a job is suitable, whether to apply, whether to rely on any information, and whether the materials you submit to an employer are accurate, complete, lawful, and appropriate.

4. Eligibility and Account Responsibilities

You must be legally capable of entering into these Terms. If you are under 18, you may use the Service only with permission and supervision from a parent or guardian who accepts these Terms on your behalf.

You agree to:

  • Provide accurate, current, and complete information.
  • Keep your account email, login method, device, and credentials secure.
  • Maintain control of the email inbox used for one-time passwords, login links, receipts, and account notices.
  • Promptly notify us at work@resourcejobs.au if you suspect unauthorised account access, payment misuse, or security issues.
  • Accept responsibility for all activity that occurs through your account unless caused by our breach of these Terms or applicable law.

We may refuse, suspend, or terminate access if we reasonably believe your account information is inaccurate, your account is being misused, your payment is disputed, your use creates risk for us or others, or you have breached these Terms.

5. Fees, Subscriptions and Cancellation

Some features are paid features. Prices, billing intervals, trial terms, discount terms, renewal terms, taxes, and included features are shown at or before checkout. The amount and interval shown at checkout are the terms that apply to your purchase.

By starting a trial, accepting an introductory offer, selecting a plan, or completing checkout, you authorise us and our payment processor to charge your selected payment method for the applicable amounts, including recurring subscription charges, until your subscription is cancelled or otherwise ends.

Trial, discounted, promotional, or introductory access may convert to a paid subscription unless you cancel before the next renewal is processed. Your subscription will continue to renew at the applicable billing interval shown at checkout or in your billing portal until cancelled.

You can cancel from Account Settings > Billing by following the cancellation process. Cancellation must be completed before the next renewal is processed to avoid the next charge. After cancellation, you will usually retain access to paid features until the end of the current billing period, unless your access is suspended or terminated under these Terms.

If a payment fails, is reversed, is disputed, or cannot be processed, we may retry the charge, ask you to update your payment method, pause paid access, suspend your account, terminate paid access, or take other reasonable steps to protect the Service.

Payments are processed by third-party payment providers such as Stripe. We do not store your full card number. Payment providers may apply their own terms, security checks, and processing times.

6. Refund Policy

This Refund Policy is part of these Terms. Nothing in this section limits, excludes, or modifies any rights you may have under the Australian Consumer Law or other non-excludable laws.

Except where required by law or expressly approved by us under this Refund Policy, fees are non-refundable and non-exchangeable. Subscription renewals, payments after a trial, payments after an introductory or discounted offer, returning-user purchases, and periods where you had access to paid features are generally not refundable.

Defects or Service Errors

We may provide a refund, credit, replacement, correction, or other remedy if the paid Service you purchased is materially defective, materially unavailable due to our error, or materially fails to perform as described, and you provide reasonable evidence of the issue.

To help us assess the issue, you must contact work@resourcejobs.au with enough detail for us to reproduce or verify the problem, such as screenshots, error messages, affected documents, dates, account email, and steps taken. We may ask you to allow us a reasonable opportunity to fix the issue before a refund is considered.

Accidental Purchases

If you believe you made an accidental purchase, you must contact us at work@resourcejobs.au within 30 minutes of the charge. Accidental-purchase refunds are discretionary and will generally only be considered where there has been no meaningful use of the paid Service after purchase, such as generating, reviewing, downloading, or materially editing paid outputs.

First-Time User Satisfaction Refund

We may offer a discretionary satisfaction refund to first-time users only. This voluntary refund path is not available to returning users, repeat purchasers, users who have previously consumed a trial or introductory offer, renewal payments, later subscription periods, or subsequent subscriptions.

To be considered for this first-time user satisfaction refund, you must contact us within 30 days of your first eligible purchase and provide reasonable evidence that all of the following conditions were met:

  • You applied for more than 100 jobs within 30 days of signing up through or in connection with your use of the platform.
  • The applications were for jobs you were reasonably qualified for and legally able to perform.
  • You used resumes generated or tailored by the Service with a platform score greater than 90.
  • You used the Service's AI review tools for the relevant resumes.
  • You used cover letters generated or tailored by the Service for the relevant applications.
  • You followed the checklist provided in the Application Kit for the relevant applications.
  • You did not receive any interviews from those applications.

We may ask for supporting evidence, including application records, document records, screenshots, platform usage history, resume scores, AI review history, checklist completion history, and any employer responses. We may deny a request if the evidence is incomplete, inconsistent, misleading, unverifiable, or shows that the conditions were not met.

Refund Processing

Approved refunds are normally issued to the original payment method. Refund timing depends on the payment processor, card network, and your financial institution. We do not control bank processing times.

You are not entitled to receive more than one refund for the same transaction. If you request a refund from us, you must not separately initiate a chargeback or payment dispute for the same transaction unless we have denied your request or failed to respond within a reasonable time.

7. Payment Disputes and Chargebacks

If you believe a charge is incorrect, unauthorised, duplicated, defective, or otherwise should be refunded, you must contact us first at work@resourcejobs.au so we can investigate and try to resolve the issue directly.

If you initiate a chargeback, card dispute, bank reversal, payment-provider dispute, or similar process, we may suspend or terminate your access to the Service while the dispute is investigated. We may also cancel your subscription, restrict future purchases, preserve relevant account records, and provide evidence to our payment processor, card networks, banks, fraud-prevention providers, advisers, regulators, or other parties involved in the dispute.

Evidence we may provide includes account identifiers, login and authentication records, checkout records, invoices, receipts, subscription status, cancellation history, refund history, communications, IP address and device information, analytics events, uploaded documents, generated outputs, download events, application kit activity, resume upload history, AI generation history, and other records relevant to whether the charge was authorised or the Service was delivered or used.

Improper, false, abusive, or fraudulent chargebacks may result in permanent account termination and may require us to take steps to recover amounts owed, reverse duplicate refunds, or protect our legal rights.

8. User Content

"User Content" means resumes, cover letters, profile details, job descriptions, prompts, application information, feedback, reviews, testimonials, files, and other materials you submit, upload, create, store, or transmit through the Service.

You retain ownership of your User Content. You grant us a non-exclusive, worldwide, royalty-free licence to host, store, copy, process, transform, transmit, display, and otherwise use your User Content as reasonably necessary to provide, secure, support, maintain, improve, and enforce the Service and these Terms.

You represent that you have the right to provide your User Content and that it does not infringe another person's rights, breach confidentiality obligations, contain unlawful material, or misrepresent your qualifications, work rights, experience, identity, or employment history.

We will not use your identifiable private resume, cover letter, profile, or application materials in public marketing without your consent. We may use public reviews, testimonials, feedback you provide to us, and anonymised or de-identified examples, statistics, or product outcomes for marketing, research, analytics, and product improvement, provided they do not reasonably identify you unless you have given explicit consent.

9. AI Outputs and User Review

The Service may generate, tailor, score, review, summarise, or suggest text using artificial intelligence ("AI Output"). AI Output may be incomplete, inaccurate, outdated, unsuitable, biased, or inconsistent with employer expectations or legal requirements.

You are responsible for reviewing, editing, verifying, and approving all AI Output before relying on it or submitting it to an employer, recruiter, job board, government body, or any third party. You must ensure that all statements about your skills, licences, tickets, qualifications, safety training, work history, right to work, salary expectations, availability, and experience are truthful and not misleading.

We do not guarantee that AI Output will pass applicant tracking systems, avoid AI-detection tools, satisfy employer criteria, comply with third-party platform rules, or produce a particular outcome.

10. Prohibited Conduct

You must not, and must not assist anyone else to:

  • Use the Service for unlawful, fraudulent, misleading, abusive, or unauthorised purposes.
  • Misrepresent your identity, work history, qualifications, licences, tickets, certifications, right to work, or eligibility for a role.
  • Upload malware, harmful code, unlawful content, confidential third-party material, or content you do not have permission to use.
  • Attempt to gain unauthorised access to accounts, systems, APIs, data, payment systems, or infrastructure.
  • Probe, scan, test, bypass, disable, or interfere with security features without written permission.
  • Scrape, crawl, harvest, copy, resell, or systematically extract data from the Service except as expressly allowed by us.
  • Reverse engineer, decompile, copy, modify, sell, lease, sublicense, or create competing products from the Service.
  • Share, rent, transfer, or resell your account or paid access.
  • Abuse trials, discounts, refunds, referrals, chargebacks, support channels, or payment systems.
  • Use bots, scripts, automation, or high-volume requests in a way that harms or burdens the Service.
  • Harass, threaten, defame, or abuse our staff, contractors, users, employers, or partners.

We may investigate suspected breaches and take any reasonable action, including limiting access, removing content, cancelling subscriptions, preserving records, reporting suspected unlawful activity, or terminating accounts.

The Service may include job listings, employer information, links, embedded content, payment processing, analytics tools, AI providers, authentication systems, hosting providers, communication tools, and other third-party services.

Third-party services are not controlled by us. We do not guarantee the accuracy, availability, legality, completeness, salary information, closing dates, eligibility requirements, or continued availability of job listings or third-party content. Employers and external platforms may change, remove, reject, ignore, or restrict applications at their discretion.

Your use of third-party websites, job boards, employer portals, payment providers, and other external services is at your own risk and may be subject to their own terms and privacy policies.

12. Intellectual Property

The Service, including its software, design, trademarks, logos, text, graphics, workflows, templates, interfaces, databases, and other materials, is owned by us or our licensors and is protected by intellectual property laws.

Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable licence to access and use the Service for your personal job-search purposes. You do not receive any ownership rights in the Service.

Feedback, suggestions, feature requests, and ideas you provide may be used by us without restriction or compensation to you.

13. Service Availability and Data Loss

We aim to provide a reliable Service, but we do not guarantee uninterrupted, secure, timely, error-free, or permanent availability. The Service may be unavailable due to maintenance, outages, provider failures, cyber incidents, third-party changes, legal requirements, or events outside our control.

You are responsible for keeping your own copies of important resumes, cover letters, job records, application materials, and other documents. We are not responsible for lost opportunities, missed deadlines, employer responses, or data loss except to the extent caused by our breach of non-excludable legal obligations.

14. Privacy

Our Privacy Policy explains how we collect, use, disclose, store, and protect personal information. By using the Service, you acknowledge that we process personal information as described in that policy.

15. Suspension and Termination

You may stop using the Service at any time. You may cancel your subscription from Account Settings > Billing.

We may suspend, restrict, or terminate your access to all or part of the Service if we reasonably believe that:

  • You have breached these Terms.
  • Your use creates legal, security, operational, reputational, payment, or fraud risk.
  • Your payment fails, is reversed, is disputed, or is suspected to be unauthorised.
  • We are required to do so by law, a regulator, a court, a payment provider, or a third-party service provider.
  • Continuing to provide the Service is no longer commercially or technically practical.

Termination does not affect rights and obligations that should reasonably continue, including payment obligations, refund limits, dispute terms, intellectual property rights, disclaimers, liability limits, indemnities, and governing law.

16. Disclaimers

To the maximum extent permitted by law, the Service and all content, AI Output, job listings, recommendations, scores, templates, checklists, and related materials are provided "as is" and "as available" without warranties, guarantees, or representations of any kind, whether express, implied, statutory, or otherwise.

We do not warrant that the Service will meet your requirements, be accurate or complete, be uninterrupted or error-free, be free from harmful components, produce any specific job-search outcome, or correct all defects.

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, remedy, or liability that cannot lawfully be excluded, restricted, or modified.

17. Limitation of Liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, exemplary, or punitive losses, including loss of opportunity, loss of employment, loss of income, loss of profits, loss of data, business interruption, reputational harm, missed applications, employer rejection, or reliance on AI Output.

To the maximum extent permitted by law, our total aggregate liability arising out of or relating to the Service or these Terms is limited to the amount you paid us for the Service in the three months before the event giving rise to the claim.

Where the Australian Consumer Law or other non-excludable law applies, our liability is limited, where permitted, to resupplying the relevant service or paying the cost of having the relevant service supplied again.

18. Indemnity

To the maximum extent permitted by law, you agree to indemnify Sigmoidal Proprietary Limited and its directors, officers, employees, contractors, agents, service providers, and affiliates from and against claims, losses, liabilities, damages, costs, and expenses arising from:

  • Your breach of these Terms.
  • Your User Content or AI Output you choose to use, submit, publish, or rely on.
  • Your unlawful, fraudulent, misleading, negligent, or unauthorised use of the Service.
  • Your misrepresentation of identity, qualifications, employment history, licences, right to work, or application information.
  • Your breach of third-party rights, third-party platform terms, confidentiality obligations, or applicable law.
  • Improper payment disputes, chargebacks, refund abuse, or unauthorised use of another person's payment method.
  • Security misuse, unauthorised access, scraping, reverse engineering, or interference with the Service.

19. Informal Dispute Resolution

Before commencing legal proceedings, you and we agree to try to resolve disputes informally and in good faith. To start this process, email work@resourcejobs.au with your account email, a clear description of the dispute, relevant dates, the outcome you seek, and supporting evidence.

We will use reasonable efforts to respond and work with you to resolve the dispute. This section does not prevent either party from seeking urgent injunctive relief, reporting unlawful conduct, responding to payment disputes, or exercising rights that cannot legally be delayed.

20. Governing Law

These Terms are governed by the laws of Western Australia and applicable Commonwealth laws of Australia. Subject to any non-excludable rights you may have, the courts of Western Australia have jurisdiction over disputes arising from or relating to these Terms or the Service.
